1. Acceptance of Terms

By downloading, installing, or using any application or game published by Kinetic Origin LLC (collectively, "our Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps.

2. Description of Service

Kinetic Origin LLC develops and publishes apps and games for iOS, Android, and Windows. Our Apps may include weather tools, word games, puzzle games, productivity tools, reference apps, AI companion apps, and other software. Some of our Apps offer both free and premium features, while others are available as one-time purchases. Specific features and pricing vary by app and are described on each app's store listing.

3. User Responsibilities

You agree to:

  • Use our Apps only for lawful purposes
  • Not attempt to reverse engineer, modify, or distribute our Apps
  • Not use our Apps to harass, abuse, or harm others
  • Not attempt to circumvent any usage limitations or security measures

4. Purchases and Subscriptions

Some of our Apps offer premium features or content available as one-time in-app purchases. All purchases are processed through the respective app store (Apple App Store, Google Play Store, or Microsoft Store) and are subject to their terms and refund policies.

We do not offer direct refunds. For refund requests, please contact the respective app store through which you made your purchase.

5. Third-Party Data and Content Disclaimer

Some of our Apps display data sourced from third-party providers, including but not limited to weather data, encyclopedia content, and other reference material. This data is provided "as is" without warranty of accuracy or completeness.

Do not rely on information from our Apps for safety-critical decisions. For weather-related emergencies, always consult official weather services. For medical, legal, or financial decisions, always consult qualified professionals.

6. AI-Generated Content

Some of our Apps use artificial intelligence to generate text, descriptions, or other content. While we strive to ensure appropriate content, AI-generated text may occasionally produce unexpected results. We are not responsible for the specific content produced by AI features.

7. AI Companion Services (Bramble)

Bramble is an AI companion app that uses artificial intelligence to provide conversational support, daily check-ins, and reflective prompts. By using Bramble, you acknowledge and agree to the following:

Not a Professional Service

Bramble is not a therapist, counselor, medical professional, or substitute for professional mental health care. Bramble is an AI chatbot designed for casual conversation and everyday emotional support. It does not diagnose, treat, or provide clinical advice for any medical or psychological condition. If you are experiencing a mental health crisis, suicidal thoughts, or any medical emergency, contact emergency services (call 911 in the US) or the 988 Suicide and Crisis Lifeline (call or text 988).

AI Limitations

Bramble's responses are generated by AI language models. They may be inaccurate, inappropriate, or unhelpful despite our efforts to ensure quality and safety. Bramble does not have memory between sessions beyond a locally stored profile summary. You should not rely on Bramble for factual information, medical guidance, legal advice, or any safety-critical decisions.

Automated Safety Features

Bramble includes automated crisis detection that scans messages for keywords indicating potential harm to self or others. When triggered, Bramble will pause the conversation and provide crisis resource information. This detection is keyword-based and has inherent limitations. It may miss indicators of distress, and it may occasionally trigger on messages that do not reflect an actual crisis. Automated crisis detection is not a substitute for human intervention, professional assessment, or emergency services.

Content Reporting

Bramble provides a reporting feature that allows you to flag AI responses as inappropriate, unhelpful, or concerning. Reported responses are stored on our servers along with the category you select. If you have enabled the "Help Improve Bramble" setting, your reports are marked as available for review by Kinetic Origin to improve safety and quality. Only Bramble's responses are included in reports — your messages are never stored on our servers through this feature.

Message Limits and Availability

Bramble enforces daily message limits that vary by tier (free or premium). These limits may change at any time. Bramble requires an internet connection and relies on third-party AI services that may experience outages or rate limiting. We do not guarantee uninterrupted access to Bramble's conversational features.

8. Intellectual Property

Our Apps, including their design, features, and content (excluding data from third-party providers), are owned by Kinetic Origin LLC and are protected by copyright and other intellectual property laws.

9. User Feedback

If you provide any feedback, suggestions, ideas, feature requests, bug reports, or other input regarding our Apps (collectively, "Feedback"), you acknowledge and agree that:

  • All Feedback is provided on a non-confidential basis, regardless of any designation or marking to the contrary
  • You grant Kinetic Origin LLC a perpetual, irrevocable, royalty-free, worldwide, fully sublicensable, and transferable license to use, reproduce, modify, distribute, display, and otherwise exploit the Feedback for any purpose, including to improve, develop, and market our Apps and future products
  • You waive any "moral rights" or equivalent rights in the Feedback to the extent permitted by applicable law
  • You have no right to compensation or attribution for any use of your Feedback
  • You represent that you have the right to provide such Feedback and that it does not infringe the rights of any third party

10. Disclaimer of Warranties

Our Apps are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Kinetic Origin LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that our Apps will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law, Kinetic Origin LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Apps, including but not limited to:

  • Inaccurate or incomplete information provided by our Apps
  • Service interruptions or unavailability
  • Data loss
  • Decisions made based on content from our Apps

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue any of our Apps or any part thereof at any time without notice. We may also update these Terms from time to time. Continued use of our Apps after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to our Apps at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kinetic Origin LLC regarding your use of our Apps, and supersede all prior agreements, communications, and understandings, whether written or oral, relating to the subject matter herein.
